Topic

The return of the tribes in the time of ירמיהו, and the laws of houses in unwalled villages (בתי החצרים): their redemption, the יובל, and הקדש.

Overview

The amud opens with the end of a discussion about whether שמיטות and יובלות were still counted after the tribes of ראובן, גד and half of מנשה were exiled. A verse in ירמיהו about freeing slaves seems to show that יובל was still kept in his time. After the answer that the verse was only a rebuke is rejected, רבי יוחנן explains that ירמיהו brought the exiled tribes back and יאשיהו ruled over them, and the גמרא brings פסוקים to prove both points. A new משנה then teaches that houses in unwalled villages (בתי החצרים) get the advantages of both walled-city houses and fields. They can be redeemed right away, and they go back to the seller in the יובל with גרעון כסף. A ברייתא learns these rules from ויקרא 25:31. רב הונא explains that ״וּבַיּוֹבֵל יֵצֵא״ teaches that such a house, made הקדש and redeemed by someone else, returns to its original owner. אביי adds that הקדש never leaves without פדיון, which the גמרא learns from a קל וחומר from a בן לוי. רבי אושעיא disagrees and holds that whoever redeems from הקדש keeps it, so רב פפא gives the פסוק a different use. A ברייתא then supports רב הונא and refutes רבי אושעיא.

Opening lines

This works well according to the Rabbis, who say:

שְׁנַת חֲמִשִּׁים אֵינָהּ מִן הַמִּנְיָן,

the fiftieth year is not part of the count,

but according to Rabbi Yehuda, who says:

שְׁנַת חֲמִשִּׁים עוֹלָה לְכָאן וּלְכָאן,

the fiftieth year counts for here and for there,

The steps (33)

  1. ChallengeWhy count יובל years according to רבי יהודה?
  2. ResolutionThat teaching does not follow
  3. ChallengeChallenge from ירמיהו: freeing slaves after seven years
  4. ProofThe 'seven years' refers to the נרצע, who goes free at יובל
  5. ResolutionThe verse is a rebuke about the past
  6. ChallengeBut the people did listen and free their slaves
  7. Resolutionירמיהו brought the tribes back and יאשיהו ruled over them
  8. ProofProof that ירמיהו brought the tribes back
  9. ProofProof that יאשיהו ruled over the returned tribes
  11. StatementNew משנה: houses in unwalled villages
  12. StatementUnwalled-village houses are compared to an ancestral field
  13. ChallengeMaybe these houses also need a two-year wait before redemption
  14. ResolutionThey can be redeemed right away
  15. ChallengeMaybe getting both advantages means they do not return in the יובל
  16. ResolutionThe פסוק says they do return in the יובל
  17. QuestionWhat does the ברייתא mean in its last question?
  18. Responseרב הונא: the case of a house made הקדש and redeemed by someone else
  19. ConclusionNeither comparison works, so the פסוק is needed
  20. ChallengeWhy only when someone else redeemed it?
  21. Resolutionאביי: הקדש does not leave without redemption
  22. QuestionWhat is the source?
  23. ResponseA קל וחומר from a בן לוי
  24. QuestionAnd how do we know it for a בן לוי?
  25. ResponseThe ברייתא limits what goes out to houses and fields
  26. ConclusionSales go out free, הקדש only with redemption
  27. Statementרבי אושעיא: whoever redeems from הקדש owns it
  28. StatementOnly a field is the exception and goes to the כהנים
  29. QuestionThen what are the words ״וּבַיּוֹבֵל יֵצֵא״ for?
  30. Responseרב פפא: it teaches about a sale with the יובל in year two
  31. ConclusionWhy the פסוק was needed: it is like neither a walled-city house nor a field
  33. ConclusionThe house goes back to the owner in the יובל
