Overview

This amud opens with the last word of the previous discussion, then starts a new משנה. The משנה rules that a man who names someone below the Torah's heir, like another person when he has a daughter or a daughter when he has a son, has said nothing. רבי יוחנן בן ברוקה says that naming someone fit to inherit him works. The גמרא infers that the first opinion also allows one son among sons, so the two opinions seem identical. A suggestion that רבי יוחנן בן ברוקה goes further is pushed back by a ברייתא from his son רבי ישמעאל. The גמרא then gives two answers: either the משנה follows the first speaker of that ברייתא, or the whole משנה is רבי יוחנן בן ברוקה with missing words. The הלכה follows רבי יוחנן בן ברוקה, and רבא finds his source in 'ביום הנחילו את בניו'. אביי objects that 'לא יוכל לבכר' already teaches this. The גמרא answers that this phrase is needed for a ברייתא of אבא חנן, which continues on the next amud.
