רבה's three fields and נכסי מלוג; אמימר's ruling and the ברייתא on whether owning the use (קנין פירות) equals owning the thing (קנין הגוף)
Overview
This amud finishes רבה's list of three fields where a wife who agreed to a sale can later say she only agreed to please her husband. The גמרא asks what the list leaves out. It rejects the idea that it leaves out the husband's other property, since there the pressure on her would be even greater. Instead it says the list leaves out נכסי מלוג, her own property that he only gets the profits of. אמימר's ruling that a sale of נכסי מלוג does nothing seems to contradict this. The first answer says אמימר meant only a sale by one spouse alone, backed by the enactment of אושא, while a sale by both or by the wife to her husband is valid. A second answer says אמימר follows רבי אלעזר, and the גמרא quotes a ברייתא about a slave sold on condition he serves the seller for thirty days. רבי מאיר says the seller counts as master, because owning the use is like owning the thing, and רבי יהודה says the buyer does, because it is not. רבי יוסי's opinion begins and continues on the next amud.
