Topic

Buying three trees and the ground between them; selling animal parts; backing out of a sale over a mismatch in the goods

Overview

The amud opens by continuing the משנה's rule that someone who buys three trees in another person's field also gets the ground between them. רב אשי asks whether a pit, a water channel, a public road or a row of palms between the trees breaks the group, and these questions stay unanswered (תיקו). רבי tells הלל that a cedar already standing between the trees does not break the group: the buyer gets both the cedar and the ground. רב says the trees may stand in a row, and שמואל says they must form a triangle, like a tripod. רב המנונא challenges שמואל's reason with thorn bushes, and the answer is that only significant plants, real trees, can give ownership of ground. A new משנה then teaches which parts of a slaughtered animal are included when one part is sold, with different rules for large and small animals. It also teaches when a buyer or seller may back out because the goods were better, worse, or a different kind of item than agreed. The גמרא begins with רב חסדא's ruling that if the buyer overpaid and the price later rose, only the buyer may cancel. His reason continues on the next amud.
