Topic

Whether a buyer's vessels (כליו של לוקח) can acquire items for him in places he does not own: the public domain, an alleyway, a shared courtyard, and the seller's own property.

Overview

The גמרא first defends רב פפא against a ברייתא that seems to say a buyer's vessels acquire for him even in the real רשות הרבים. It answers that the ברייתא means a סמטא (alleyway). It also explains that 'a courtyard that belongs to neither of them' means a courtyard owned by both partners together. Then רב ששת asks רב הונא whether a buyer's vessels acquire for him when they sit in the seller's property. רב הונא proves they do from the משנה in גיטין about a גט thrown into a woman's lap or basket. רב נחמן rejects this proof, because many אמוראים, and רבי יוחנן as explained by רבא, limit that משנה to special cases. Next the גמרא tries to prove the opposite from a ברייתא about acquiring in the seller's domain. That ברייתא turns out to be about whose vessels the goods are in, so it does not settle the question. Finally רבא brings a new ברייתא about a buyer who pulled donkey drivers and laborers carrying goods into his house, and the discussion continues on the next amud.
