Topic
Who may eat a בכור בעל מום, and how much holiness blemished קדשים keep
Overview
This amud discusses who may eat a בכור that has a blemish (בכור בעל מום) and how such an animal must be treated. בית הלל use a קל וחומר from a טמא כהן to prove that a זר may eat it, and they defend it by saying we compare only eating, not service. רבי עקיבא goes further and allows even a גוי, learning from 'כצבי וכאיל'. The other תנא needs every mention of 'צבי ואיל' for other lessons. Next, a ברייתא brings a מחלוקת about feeding a blemished בכור to נדות. בית שמאי forbid it, and they allow only טומאה from outside the body, using a proof from קרבן פסח. בית הלל permit it, because the פסוק says plain 'טמא'. Finally, a ברייתא forbids skinning a בכור or פסולי המוקדשין from the feet. רב חסדא says the בכור clause follows בית שמאי and the פסולי המוקדשין clause follows רבי אלעזר ברבי שמעון, because a בכור's holiness from birth may be uniquely strong.
Opening lines
And Beit Hillel [would respond]:
הָנֵי מִילֵּי תָּם,
This statement applies only to an unblemished [firstborn],
but about a blemished one it is written:
״הַטָּמֵא וְהַטָּהוֹר יַחְדָּיו יֹאכְלֶנּוּ״,
"The impure and the pure may eat it alike."
The steps (25)
- Resolutionבית הלל limit the earlier source to an unblemished בכור
- Proofבית הלל's קל וחומר from an impure כהן to a non-כהן
- ChallengeBreaking the קל וחומר: an impure כהן is allowed in communal service
- Resolutionבית הלל: the topic is eating, and a non-כהן is stronger in eating
- QuestionWhy does רבי עקיבא allow even a gentile?
- ResponseLike a gazelle and a deer: permitted to a gentile
- QuestionWhat does the other תנא do with 'צבי ואיל'?
- Response'צבי ואיל' is written three times, each for another lesson
- ResponseOne more lesson: disqualified קדשים are exempt from בכורה
- StatementA ברייתא: may a בכור be fed to נדות?
- QuestionWhat is בית שמאי's reason?
- Resolutionבית הלל: that comparison is only about a בכור תם
- Resolutionבית שמאי limit the verse to outside impurity
- ProofProof from קרבן פסח that the תורה splits the two kinds of impurity
- Rejectionבית הלל: the פסח split comes from a special word
- StatementNo skinning from the feet on יום טוב, or for a בכור or פסולי המוקדשין
- QuestionThe יום טוב case makes sense, but who taught the בכור case?
- QuestionWho taught the case of פסולי המוקדשין?
- ProofThe case of two חטאות: one תמימה, one with a מום
- Proofרבי אלעזר ברבי שמעון: even meat already in the pot becomes forbidden
- ChallengeWhy not attribute the whole ברייתא to בית שמאי?
- Resolutionבית שמאי may be strict only with a בכור
