Confessing to a קנס: seduction and theft, and whether the half-damage of a תם ox is ממון or קנס

Overview

The משנה teaches that a person who confesses pays real damages, like בושת ופגם or the stolen קרן, but never pays a קנס based on his own admission. The general rule is that any payment above the actual damage is a קנס, and a confession cannot make him pay it. The גמרא explains that the משנה chose seduction over rape because seduction is the bigger חידוש: even though his words tarnish the girl, he still pays. רבי שמעון disagrees and says he cannot tarnish her, so he pays nothing. Even if she, her father, and her family agree, some relative far away will always object. The גמרא then brings a dispute between רב פפא and רב הונא בריה דרב יהושע about whether the half-damage paid for a תם ox is ממון or קנס. Each view depends on whether ordinary oxen are assumed to be safe. The גמרא tests this with a משנה about the damaged party sharing in the payment and with a ברייתא listing the differences between תם and מועד. The discussion of whether חצי כופר counts as something the list left out continues on the next amud.
