Overview

The משנה lists things you may not use, but which carry no מעילה if you do. These are tree roots that cross between private and הקדש land, a spring flowing through a הקדש field, the water in the golden jug for the סוכות water libation, and the ערבה for the מזבח. Once the water is put into the flask, which is a כלי שרת, it does carry מעילה. רבי אלעזר ברבי צדוק adds that the elders used the ערבה in their לולבים. In the גמרא, ריש לקיש first seems to say that three לוגין in the jug carry מעילה. The גמרא challenges this from the משנה and moves his statement to the flask: there, only three לוגין carry מעילה, while רבי יוחנן says all of it does. The גמרא then asks whether ריש לקיש elsewhere implied that water has no measure, and answers that he was only arguing within מנחם יודאפה's approach. A new משנה then teaches about a nest on a הקדש tree, a nest on an אשירה, and a consecrated forest.

one may not benefit from them, and there is no מעילה.
