A son using his father's נזירות money: the מחלוקת with רבי יוסי and unresolved questions about its details
Overview
This amud opens by finishing an earlier answer: a son may use his dead father's נזירות money because of a special הלכה, not because he inherits it. Then the גמרא asks whether the רבנן disagree with רבי יוסי about when a son may do this, and if so, on which case. It brings a ברייתא where רבי יוסי allows it only when the son became a נזיר after his father died. רבי אליעזר, רבי מאיר and רבי יהודה answer that 'this is the one' who may use the money, reversing רבי יוסי. Next comes a chain of questions: what if there are two sons, a בכור and a regular son, or money that is הקדש? What if father and son had different kinds of נזירות, or one was טמא and the other טהור? All of these end with תיקו, without an answer. The פרק מי שאמר then closes, and a new פרק opens with בית שמאי's ruling that a mistaken הקדש still counts.
