הפקר that can be taken back within three days: the tithing worry, and the vineyard ברייתא that challenges ריש לקיש

Overview

The גמרא is discussing someone who declares his field הפקר (ownerless) and may take it back within three days. עולא holds that by Torah law the הפקר works right away, and the three days are only a rabbinic rule. ריש לקיש holds that the הפקר does not take effect during those three days. First the גמרא worries that עולא's view could lead people to tithe obligated produce using exempt produce, or the reverse. It answers that we tell the person to tithe the produce from itself. Then it brings a ברייתא: someone who made his vineyard הפקר and picked it at dawn must give the gifts for the poor but is exempt from מעשר. This fits עולא but seems to challenge ריש לקיש. The גמרא answers for ריש לקיש that his explanation followed רבי יוסי, while this ברייתא follows the רבנן, who hold that הפקר works immediately.
