Vows between partners: the shared courtyard dispute and how big an owner's share (תפיסת יד) in a bathhouse must be to forbid it
Overview
The amud continues the משנה about two partners in a courtyard who vowed not to benefit from each other. The חכמים forbid both of them to enter it, while רבי אליעזר בן יעקב says each one enters his own portion. One version of זעירי's teaching says the מחלוקת is only about a courtyard big enough to divide. רב יוסף challenges this from a בית הכנסת: it cannot be divided, yet a משנה forbids it. So he reverses the teaching: the מחלוקת is about a courtyard too small to divide, and in a large courtyard everyone forbids. רב הונא and רבי אלעזר both rule like רבי אליעזר בן יעקב. Then the גמרא turns to the משנה about a friend's bathhouse and asks how big a share counts as תפיסת יד. רב נחמן says a half, a third or a quarter, while אביי says even less forbids, so it is permitted only when the owner takes a fixed rent (טסקא).
Opening lines
מַחְלוֹקֶת שֶׁיֵּשׁ בָּהּ כְּדֵי חֲלוּקָּה.
The dispute is where the courtyard has enough to be divided.
אֲבָל אֵין בָּהּ כְּדֵי חֲלוּקָּה —
But where it does not have enough to be divided,
דִּבְרֵי הַכֹּל מוּתָּר.
everyone agrees it is permitted.
