רבי יהושע's solution for a מצורע whose offerings were mixed up, and רב ששת's challenge to שמואל's explanation of it
Overview
This amud opens with the end of רבי יהושע's answer about a man who remarries his divorced wife. From the פסוק he learns that the woman herself is a תועבה, but her children are not. Next comes a new question: two מצורעים had their offerings mixed up, one offering was brought, and then one man died. רבי יהושע says the survivor should give away his property, become poor, and bring a bird חטאת, which may be brought even on a doubt. The גמרא asks what happens with the animal אשם, and שמואל answers that the case is one where the אשם was already brought. רב ששת attacks שמואל's answer from two sides, using a משנה that records which offering decides whether a מצורע counts as rich or poor. Under רבי יהודה, an אשם brought while rich locks him into rich offerings, so the bird חטאת fails. Under רבי שמעון, the survivor could simply bring a new אשם with a condition, so שמואל's limit is not needed. A ברייתא proves that רבי שמעון allows bringing an אשם with a condition, and its next detail continues on the next amud.
