Lay judges in money cases, רבא and רב אחא on why three judges are needed, and why the משנה lists נזק and חצי נזק

Overview

The amud opens by finishing רבי חנינא's teaching. By Torah law, money cases need the same careful questioning of witnesses (דרישה וחקירה) as capital cases. The חכמים relaxed this so lenders won't stop lending, and that is also why non-expert judges (הדיוטות) may judge loan cases. Even so, הדיוטות must pay if they make a mistake, because otherwise lenders would be scared off even more. The גמרא then shows two problems with רבי אבהו's reading of the משנה. In response, רבא explains that the משנה teaches two separate rules. רב אחא בריה דרב איקא says instead that by Torah law one judge is enough, and the חכמים required three because of יושבי קרנות. The practical difference between them is שמואל's rule that a court of two is valid but called a בית דין חצוף. Finally, the גמרא asks why the משנה lists 'damage' and 'half damage', tries the answer that half damage is a קנס, rejects it, and begins a new answer that continues on the next amud.

שֶׁנֶּאֱמַר: ״מִשְׁפַּט אֶחָד יִהְיֶה לָכֶם״.

As it says: 'You shall have one law.'

And what is the reason they said

דִּינֵי מָמוֹנוֹת לָא בָּעֵינַן

that money cases do not need

דְּרִישָׁה וַחֲקִירָה?

questioning and cross-examination of witnesses?
