Whether a woman whose baby died within thirty days must perform חליצה, and the limits of רבי יהודה's view that an אנדרוגינוס is male
Overview
This amud begins by finishing a dispute about what רבא ruled. The case is a woman whose husband died leaving only a baby, and the baby died within thirty days, so it may have been a נפל. That means she might still be bound to her husband's brother for יבום, and in the meantime she married someone else. רבינא reports that רבא ruled that a ישראל's wife does חליצה but a כהן's wife does not, since a חלוצה is forbidden to a כהן. רב שרביא reports that רבא said both must do חליצה. רבינא answers that רבא said that at night but retracted in the morning, and רב שרביא replies with a sarcastic rebuke. The גמרא then returns to the משנה, where רבי יהודה permits a ברית מילה on שבת for an אנדרוגינוס. רב חסדא limits this: רבי יהודה does not treat an אנדרוגינוס as male in every area, since he is excluded from ערכין. A ברייתא proves that exclusion. The verses 'הזכר' and 'ואם נקבה היא' cover only a definite male and a definite female, so a טומטום and an אנדרוגינוס get no valuation at all.
Opening lines
אִם אֵשֶׁת יִשְׂרָאֵל הִיא — חוֹלֶצֶת.
If she is the wife of an Israelite — she performs chalitza.
אִם אֵשֶׁת כֹּהֵן הִיא — אֵינָהּ חוֹלֶצֶת.
If she is the wife of a kohen — she does not perform chalitza.
וְרַב שֵׁרֵבְיָא מִשְּׁמֵיהּ דְּרָבָא אָמַר:
And Rav Sherevya said in the name of Rava:
אַחַת זוֹ וְאַחַת זוֹ — חוֹלֶצֶת.
Both this one and that one — perform chalitza.
