Topic

Forced payment and תקנת הלל, then which properties and which cities count as בתי ערי חומה.

Overview

The amud opens by finishing a debate about תקנת הלל. A seller of a house in a walled city may buy it back within a year, and הלל allowed him to pay even when the buyer hid from him. In two opposite versions, רבא learns from this whether money forced on someone counts as giving, for a גט given on condition of two hundred זוז. In each version, רב פפא pushes back on the proof. A new משנה then rules that everything inside a city wall is treated like בתי ערי חומה except fields, and the גמרא brings the פסוק sources for רבי יהודה and רבי מאיר. It then narrows their dispute to a quarry and a sand bed. רבי יוחנן shows that the argument over a house built into the wall comes from one פסוק about רחב. A second משנה defines a walled city: a real wall all around since the days of יהושע בן נון, and at least three courtyards of two houses each. The גמרא brings ברייתות that exclude roof-walls and טבריה, and that keep walled status for a city whose wall is gone. The amud ends by asking what a ברייתא means when it sorts the walled cities by region, and the answer comes on the next amud.

Opening lines

מִדְּאִיצְטְרִיךְ לֵיהּ לְהִלֵּל

From the fact that it was necessary for Hillel

לְתַקּוֹנֵי נְתִינָה בְּעַל כׇּרְחוֹ הָוְיָא נְתִינָה,

to institute that giving against his will is considered giving,

הָא בְּעָלְמָא

this shows that in general

נְתִינָה בְּעַל כׇּרְחוֹ לָא הָוְיָא נְתִינָה.

giving against his will is not considered giving.
