Changing charity and synagogue donations; ערכין, vows, and damages of a גוסס and a יוצא ליהרג
Overview
The amud opens by asking how רבי ינאי could borrow charity money and repay it. The answer is that his borrowing actually helped the poor. A ברייתא then teaches that a Jew's donated מנורה or נר for a בית הכנסת may not be changed. רבי יוחנן limits this to voluntary uses, so changing it for a מצוה is allowed. A non-Jew's donation is different: it may not be changed while his name is remembered, since he might protest. The story of שעזרק's lamp shows the sages disagreeing over whether that worry applied to him. Next comes a new משנה about a גוסס and a יוצא ליהרג, discussing vows, ערכין, and liability for damage. The גמרא uses ״כׇּל חֵרֶם לֹא יִפָּדֶה״ to explain both sides of the ערכין dispute. It then shows that the real argument between the תנא קמא and רבי יוסי is about damage. רב יוסף and רבא each give a reason for that argument, and some place their dispute on a different ברייתא.
