Leaving kosher wine made from a non-Jew's grapes in the non-Jew's property: when it stays permitted and when we worry he touched it
Overview
The amud opens with the end of an earlier answer: the barrel sent into the vat is a case where the נכרי pushes it along again and again, so he may have touched the wine. Then a new משנה begins. A Jew makes kosher wine from a נכרי's grapes and leaves it in the נכרי's house that faces a public street. In a mixed city it is permitted, but in an all-non-Jewish city it needs a Jewish guard, who may come and go. רבי שמעון בן אלעזר says the domain of non-Jews is all one. If the נכרי writes a receipt saying he was paid, the wine is permitted. If he holds the wine until he is paid, it is forbidden, as happened in בית שאן. The גמרא asks why an all-non-Jewish city is different, since Jewish peddlers travel everywhere, and שמואל answers that the משנה means a city with locked gates. רב יוסף adds that a window, a trash heap, or a palm tree works like a public street, and רב אחא and רבינא argue about a palm tree whose top was cut off. Finally, a ברייתא teaches that wine in a house a Jew bought or rented in a non-Jew's courtyard is permitted if a Jew lives in that courtyard, even without a key or seal.
