When a guarantor (עָרֵב) needs a קנין to be obligated, and the closing of מסכת בבא בתרא
Overview
This last amud of מסכת בבא בתרא finishes the discussion of when a guarantor (ערב) becomes legally bound. First, the גמרא draws an inference from an earlier ruling. Only a guarantor who commits in front of a בית דין is bound without a קנין, so an ordinary guarantor needs a קנין. Then the גמרא gives the final הלכה. A guarantor who commits when the loan money is handed over needs no קנין. One who commits after the money was already given needs a קנין. A guarantor in front of a בית דין needs no קנין, because he enjoys being trusted by the court and so truly commits. The amud ends with the הדרן closing פרק גט פשוט and the whole מסכת.
