Who acquires straw and hay left in the public domain (רשות הרבים)? The מחלוקת between רב and זעירי over whether חכמים penalized the owner by taking the items themselves (גופן) or only their improvement (שבחן).
Overview
The גמרא first finishes an earlier answer: the משנה spoke of straw and hay because they are especially slippery. It then turns to the rule that whoever comes first acquires them. רב says the taker gets the items themselves and their improvement, while זעירי says he gets only the improvement, because they disagree over how far the חכמים' קנס goes. The גמרא challenges רב from the case of dung, and רב נחמן בר יצחק answers that the penalty applies only to things that improve, which dung does not. A question about whether the penalty starts right away or only once the item improves is raised, but the proof offered for it is rejected. The גמרא then tries to link רב and זעירי to two disputes of תנאים: one about a loan document with ריבית, and one in a ברייתא where רבן שמעון בן גמליאל argues with the תנא קמא. Each time, רב and זעירי can fit their views into both sides. רב explains the ברייתא as an argument over whether the law may be taught publicly. The amud ends as the גמרא begins to question that by citing what רב הונא and רב אדא בר אהבה actually did, and the challenge continues on the next amud.
