Measuring צער, the rules of ריפוי and a reopened wound, and paying the other payments along with נזק

Overview

This amud finishes the מחלוקת between רבי and בן עזאי about whether a כלל ופרט still works when other words separate the two terms. It explains why רבי still needs the word חבורה. The גמרא then asks how to measure צער when there is also נזק. After several attempts, it settles on what a person would pay to have a hand that the government already condemned removed by a painless drug instead of a sword. Next comes ריפוי. A ברייתא gives three views on a wound that reopens, and רבה explains the dispute through the rules of bandaging and the doubled phrase ורפא ירפא, which also teaches that a doctor may heal. The גמרא then lists practical rules about which kind of medical care each side may refuse. Last, a ברייתא says all the payments are added on top of נזק, and רב זביד brings the source פצע תחת פצע. A challenge to that source begins at the end of the amud and continues on the next amud.

וּבֶן עַזַּאי סָבַר: דָּנִין אוֹתוֹ בִּכְלָל וּפְרָט.

and בן עזאי holds: we do interpret it with the rule of general and specific.
