Whether גיד הנשה applies to a non-kosher animal, and how רבי יהודה's view fits with אין איסור חל על איסור

Overview

The amud opens by finishing an earlier discussion about a forbidden piece cooked in a pot. It uses the rule of מין ומינו ודבר אחר: the same kind of food is ignored, and only the different kind can cancel the forbidden piece. Then a new משנה teaches that גיד הנשה applies only to a kosher animal, while רבי יהודה says it applies to a non-kosher animal too. רבי יהודה's proof is that בני יעקב were already forbidden the גיד when non-kosher animals were still permitted to them. The חכמים answer that the איסור was really given at סיני. The גמרא then asks how רבי יהודה can hold this, since a ברייתא shows he holds אין איסור חל על איסור. The גמרא first suggests that both איסורים start together in the שליל, but a משנה about a נזיר shows the non-kosher איסור comes first. The final answer is that the גיד הנשה איסור takes effect anyway because it also applies to בני נח, and רבי יהודה's own wording in the משנה supports this. The amud ends as the גמרא returns to study the ברייתא about two sets of lashes, a discussion that continues on the next amud.

Opening lines

אֲפִילּוּ תֵּימָא לֹא קָדַם וְסִלְּקוֹ,

You may even say he did not first remove it,

הָוֵי מִין וּמִינוֹ וְדָבָר אַחֵר.

it is a case of a type with its own type and something else.

וְכׇל מִין וּמִינוֹ וְדָבָר אַחֵר –

And in any case of a type with its own type and something else –

סַלֵּק אֶת מִינוֹ כְּמִי שֶׁאֵינוֹ,

remove its own type as though it is not there,

  7. ProofThe ברייתא about a non-kosher bird's carcass
  8. ProofThe verse excludes a non-kosher bird from carcass טומאה
  9. ResolutionMaybe the nerve has no taste, so only one prohibition applies
  10. Challengeרבי יהודה gives two sets of lashes, so the nerve must have taste
  11. ResolutionBoth prohibitions start together in the unborn calf
  12. ChallengeDoes רבי יהודה really apply גיד הנשה to a fetus?
  13. Resolutionרבי יהודה exempts a fetus only in a kosher animal
  14. ChallengeDo both איסורים really start at the same moment?
  15. ProofA fetus has limbs before sinews, so the non-kosher איסור comes first
  16. ResolutionThe nerve prohibition still takes effect because it applies to בני נח
  17. Proofרבי יהודה's wording supports the בני נח reasoning
  18. StatementReturning to the ברייתא: רבי יהודה gives two punishments
