Topic

The end of the קנין פירות discussion, the close of פרק השולח, and the opening משנה and גמרא of פרק הניזקין on which grade of land pays each kind of claim.

Overview

The amud opens by finishing the argument over whether owning a field's produce counts as owning the field itself. The גמרא brings support for ריש לקיש, who says it does not: a פסוק about selling 'years of crops,' and a ברייתא about a בכור. אביי adds that a husband needs הרשאה from his wife to go to court over her land, unless the case also involves the produce, because of a מיגו. The chapter השולח then ends, and the new chapter הניזקין begins. Its משנה ranks land for payment: נזיקין from עידית, a debt from בינונית, and a כתובה from זיבורית. It then lists limits on collecting, ending with rules made מפני תיקון העולם. The גמרא asks how the נזיקין rule can be a rabbinic fix when a פסוק teaches it. אביי answers that this fits רבי ישמעאל's view, which leads to a debate over that view that continues onto the next amud.
