The opening of פרק אלו נערות: which young women receive the קנס, and the dispute between רבי מאיר and חכמים about the קנס for a קטנה
Overview
The third פרק of כתובות opens with a משנה listing young women whose rapist must pay the קנס even though they have flawed lineage, such as a ממזרת, a נתינה and a כותית. It adds converts, captives and maidservants whose new status began before age three years and one day. It also adds forbidden relatives and a נדה, because those sins carry כרת and not מיתת בית דין. The גמרא asks whether the list means girls with proper lineage get no קנס. It answers that the list only adds the flawed cases. The גמרא then notes that the משנה speaks of a נערה and not a קטנה, and רב identifies this with רבי מאיר. A ברייתא shows that רבי מאיר holds a קטנה can be sold but gets no קנס, and a נערה gets the קנס but cannot be sold. חכמים give the קנס from age three years and one day. The גמרא asks whether חכמים deny the father's right of sale, and it begins to correct their wording, a correction that continues on the next amud.
