Topic

Acquiring many fields with one חזקה, and the תורה source for גלגול שבועה

Overview

The amud opens with the end of a ברייתא. Taking possession (חזקה) of one field acquires all the fields in the sale, but only if the buyer paid for all of them. The גמרא says this supports שמואל, who rules that ten fields in ten different places are all acquired through a חזקה on one. רב אחא בריה דרב איקא compares the fields to ten animals tied to one bridle, first to support שמואל and, in a second version, to argue against him. Both comparisons are pushed away, and שמואל stands because all land counts as one connected mass. The גמרא then turns to the משנה's rule that movables pull land into an oath. עולא brings the תורה source for גלגול שבועה from the סוטה's double 'אמן'. Her oath covers her time as an ארוסה, and the גמרא shows this can only work by extending an oath she already has to take. Finally, the גמרא asks how we know גלגול applies to money matters, and דבי רבי ישמעאל begins a קל וחומר from סוטה that continues on the next amud.

Opening lines

בַּמֶּה דְּבָרִים אֲמוּרִים –

In what case are these words said?

שֶׁנָּתַן לוֹ דְּמֵי כוּלָּן,

When he gave him the money for all of them,

אֲבָל לֹא נָתַן לוֹ דְּמֵי כוּלָּן –

but if he did not give him the money for all of them,

לֹא קָנָה אֶלָּא כְּנֶגֶד מְעוֹתָיו.

he acquires only as much as matches his money.
