Topic
Whether a קונם prohibition stays on an item after it is given as a gift, and whether the laws of מעילה apply to קונמות
Overview
The גמרא challenges רבא with a ברייתא about a man who refused to lend his cow or spade and made a vow. The ברייתא says the item becomes permitted once the vower dies or once it is given as a gift. רב אחא בריה דרב איקא answers that the gift came through a third person, not from the vower himself. רב אשי supports this from the ברייתא's wording: 'it was given,' not 'he gave.' Then a new topic opens. רבא asks רב נחמן whether the laws of מעילה (misusing הקדש) apply to items forbidden by a קונם. רב נחמן proves from a משנה that a קונם is like הקדש, so there is מעילה. The גמרא shows this is a dispute: רבי מאיר holds there is מעילה in קונמות, and the חכמים hold there is not. Finally, רב אשי rules that when someone gives a forbidden loaf as a gift, the receiver commits מעילה once he uses it.
