Topic

Who is obligated in סוכה (women, גרים, minors), and living in the סוכה as one's permanent home.

Overview

This amud opens by finishing a challenge from the previous amud. Why do we need a special הלכה to exempt women from סוכה, and a verse to include women in יום הכפורים, when general rules already seem to cover both? אביי and רבא each explain why the הלכה for סוכה was still needed. The גמרא then shows that the verse 'האזרח' includes גרים in סוכה, and that the יום הכפורים verse obligates women in תוספת עינוי. Next it explains that 'כל' includes only a minor who has reached חינוך, and that this is מדרבנן with the verse as an אסמכתא. It defines a child who 'no longer needs his mother', and explains the story of שמאי הזקן making a סוכה for a newborn as following שמאי's stricter view. A new משנה teaches that the סוכה is one's permanent home for seven days, that heavy rain lets one leave, and gives a parable explaining what rain means. The גמרא ends by teaching from תשבו כעין תדורו how to live in the סוכה, including that review of Torah happens there while deep analysis is done outside.

Opening lines

הִשְׁוָה הַכָּתוּב אִשָּׁה לְאִישׁ

לְכׇל עוֹנָשִׁין שֶׁבַּתּוֹרָה.

for all punishments in the Torah.

אָמַר אַבָּיֵי:

Abaye said:

Actually, sukkah is a halacha, and it was necessary.
