The dispute between אביי and רבא about whether an act the תורה forbids still takes effect. Here the גמרא challenges רבא's view (it does not take effect) using two cases: consecrating unblemished animals for בדק הבית, and robbery.

Overview

אביי and רבא argue about whether an act the תורה forbids still takes effect. רבא says it does not, and אביי says it does. The גמרא first tests רבא with three cases where a forbidden act seems to work: consecrating an unblemished animal for בדק הבית, a robber who changes the stolen item, and a lender who wrongly takes collateral. Each time, רבא says a special source covers that case, and the גמרא shows what אביי learns from those same פסוקים instead. Then the גמרא tests אביי with פאה: even after the owner wrongly harvests the corner, he must still give it to the poor. אביי answers with the extra word ״תעזוב״, and רבא uses that word for someone who makes his vineyard ownerless and then harvests it. Since every case has now been explained by both sides, רב אחא בריה דרבא asks where they really disagree. רב אשי answers that they disagree about רבית קצוצה, following רבי אלעזר, who says the judges take it back from the lender. The explanation continues on the next amud.

Opening lines

״נְדָבָה תַּעֲשֶׂה אֹתוֹ״ —

"That may you offer as a gift"

זֶה קׇדְשֵׁי בֶּדֶק הַבַּיִת,

this refers to consecrations for Temple maintenance,

וּתְנַן: הַמַּקְדִּישׁ תְּמִימִין לְבֶדֶק הַבַּיִת,

and we learned: one who consecrates unblemished animals for Temple maintenance,

אַף עַל פִּי שֶׁהוּא בְּלֹא תַעֲשֶׂה

even though he is breaking a prohibition,
