Late מילה by day or night, רבי יוחנן's נוֹתָר rule, and who is fit for the rites of the פָּרָה אֲדוּמָּה
Overview
The amud opens by finishing a ברייתא in which רבי אלעזר בר שמעון says an on-time מילה must be by day, but a late מילה may be at night. The גמרא first suggests the dispute is about whether a מָשׁוּךְ needs מילה by Torah law. It rejects this and explains instead that the two sides argue over whether we learn from the extra ״וּבַיּוֹם״. רבי יוחנן teaches a similar rule about burning נוֹתָר. רבי אלעזר challenges him from a ברייתא and from the letters ו׳ and ה׳ in ״וְהַנּוֹתָר״, and רבי יוחנן is silent. A story follows: רבי יוחנן praises רבי אלעזר, ריש לקיש shows the teaching comes from תורת כהנים, and רבי יוחנן masters that work. רבי אלעזר then rules that an עָרֵל's sprinkling of פָּרָה אֲדוּמָּה water is valid, using a קל וחומר from a טְבוּל יוֹם. A ברייתא about a טוּמְטוּם seems to disagree, and רב יוסף assigns it to the school of רבי עקיבא, which treats an עָרֵל like a טָמֵא. The amud ends with the dispute between the רבנן and רבי יהודה about who may sanctify the water. They argue over how to read ״וְלָקְחוּ״ and ״וְנָתַן״, which explains why a קטן or a woman is fit or unfit.
Opening lines
they may be circumcised only during the day;
not at its proper time, they may be circumcised during the day or at night.
Is it not that they disagree about this:
דְּמָר סָבַר מָשׁוּךְ דְּאוֹרָיְיתָא,
that one Sage holds a מָשׁוּךְ needs circumcision by Torah law,
The steps (26)
- StatementEnd of רבי אלעזר בר שמעון's ruling on late circumcision
- ProofSuggestion: the dispute is about whether a מָשׁוּךְ is Torah law
- RejectionRejection: a child past his eighth day surely needs מילה by Torah law
- ResolutionNew explanation: they argue about learning from ״וּבַיּוֹם״
- ProofA parallel: רבי יוחנן on burning נוֹתָר
- Challengeרבי אלעזר challenges רבי יוחנן from a ברייתא about late מילה
- ChallengeThe letters ו׳ and ה׳ in ״וְהַנּוֹתָר״ teach the same rule, and רבי יוחנן is silent
- Rejectionריש לקיש shows it is a ברייתא, and רבי יוחנן masters תורת כהנים
- StatementAn עָרֵל who sprinkles פָּרָה אֲדוּמָּה water does so validly
- ChallengeMaybe a טבול יום is better off than an ערל
- ResolutionThe comparison is about touching, not eating
- ProofA ברייתא and a real case support רבי אלעזר
- ChallengeA ברייתא says an ערל may not prepare the water
- ResolutionThat ברייתא follows the school of רבי עקיבא
- Challengeרבא asks why no source lists the עָרֵל with the טָמֵא
- ChallengeThere is a source listing them together: exemption from coming to the בית המקדש
- RejectionThat source has a different reason: the עָרֵל is repulsive
- StatementThe רבנן and רבי יהודה follow their usual views
- QuestionWhat is the רבנן's reason for their list of who may sanctify
- ResponseSanctifying follows the same rules as gathering the ashes
- Resolutionרבי יהודה reads the plural word as separating the two jobs
- ChallengeThen a woman should also be fit
- ResolutionThe verse says he places, not she places
- ResolutionThe רבנן: the plural shows one person need not do both jobs
- ConclusionThe רבנן: two may take and one may place
