Who keeps the כתובה in forbidden marriages, and the cases where the two reasons split; then a new משנה on when engagement, pregnancy, or waiting for a יבם affects eating תרומה and מעשר
Overview
The amud finishes a ברייתא about why some forbidden marriages still come with a כתובה and others do not. רבי שמעון בן אלעזר says it depends on whether the couple becomes disqualified. רבי says Torah bans need no extra penalty, while rabbinic bans like שניות do. A third reason, 'who encourages whom', is credited either to רבי שמעון בן אלעזר or to רבי, who added it because of the case of a חלוצה. The גמרא then looks for a case where these reasons give different results. It tries a ממזרת married to a regular Jew, a man who remarries his ex-wife after she married someone else, a בעולה married to a כהן גדול, and a ספק סוטה. Each case is rejected by some תנא's view that the marriage would harm her or her children. The case that finally holds up is a definite סוטה. A new משנה then teaches that engagement, pregnancy, or waiting for a יבם can take away a woman's right to eat תרומה or מעשר but can never give it. The גמרא asks why מעשר is mentioned at all, and answers that the משנה follows רבי מאיר, who forbids מעשר ראשון to non-Levites. The ברייתא that proves this comes on the next amud.
Opening lines
קָנְסוּ אוֹתוֹ כְּתוּבָּה.
they penalized him with the marriage contract.
וּמִפְּנֵי מָה אָמְרוּ
And for what reason did they say
שְׁנִיּוֹת מִדִּבְרֵי סוֹפְרִים אֵין לָהֶן כְּתוּבָּה —
that secondary relatives forbidden by rabbinic law have no marriage contract?
מִפְּנֵי שֶׁהוּא כָּשֵׁר וְהִיא כְּשֵׁרָה.
Because he is fit and she is fit.
