Does רבי עקיבא hold that a person can transfer or forbid something that does not exist yet (דבר שלא בא לעולם)? A proof from the vow 'קונם whatever I make for your mouth', a rejection of that proof, and a chain of rabbis showing that רבי עקיבא does allow it.
Overview
The גמרא brings a משנה about a wife who uses a נדר to forbid her future earnings to her husband. The first opinion says the husband does not need to annul it. רבי עקיבא says he should annul it, which seems to show that a נדר can take hold on things that do not exist yet. The גמרא rejects this proof: רב הונא בריה דרב יהושע explains that she vowed on her hands, which already exist. The גמרא then notes that this conflicts with רב נחמן בר יצחק. He traces a chain of rabbis, from רב הונא back to רבי עקיבא, who all hold 'אדם מקנה דבר שלא בא לעולם'. The גמרא then shows the source for each name. For רב הונא it is his ruling on selling palm fruit before it grows, and רב נחמן disagrees with that ruling. For רב it is giving away a field before buying it. For רבי ינאי and רבי חייא it is a story about separating מעשר for fruit that had not arrived yet. רבי חייא supports his ruling with a ברייתא about 'all the days', and the גמרא begins working out what law that ברייתא teaches. That discussion continues on the next amud.
