Which invalidly pinched or slaughtered bird offerings make one impure in the throat like a נבלה, and which disqualified offerings come down from the מזבח

Overview

The גמרא first shows that the משנה's two general clauses each add their own case (שחיטת קדשים בפנים and מליקת חולין בחוץ), so the משנה says nothing about מליקת זר. A ברייתא then supports רבי יוחנן: a bird pinched by a זר does not make one impure in the throat. רבי יצחק heard that one of קמיצת זר and מליקת זר comes down from the מזבח and one does not, and חזקיה reasons that the קמיצה comes down. The גמרא defends this split: a מנחה on a בָּמָה had no קידוש in a כלי שרת, so the בָּמָה cannot serve as a model for a Temple מנחה. Two ברייתות then use the word 'טריפה' to decide which badly killed birds make clothing טמא in the throat. The test for pinching is whether the act permits something forbidden. The test for slaughter is whether the bird is the same inside and outside the עזרה. רבא adds that slaughter outside, which brings כרת, keeps the bird from being a נבלה. רב שימי בר אשי limits the comparison to two improper acts, and a challenge from a ברייתא about a יוצא is answered with the פסוק 'זאת תורת העולה'. Finally a new משנה opens: רבי מאיר rules that a properly pinched bird found to be a טריפה does not make one impure in the throat.
