Why בית דין does not collect debts from young orphans' property (רב הונא בריה דרב יהושע, רב פפא, רבא), and the final הלכה on getting involved and appointing an אפוטרופוס.

Overview

Earlier, the גמרא gave two reasons why בית דין does not collect a debt from the property of young יתומים. רב הונא בריה דרב יהושע worries that the father may have already paid. רב פפא says paying a debt is a מצוה, and minors are not obligated in מצוות. The גמרא tests both reasons against a משנה and then a בריתא, both about announcing the sale of orphans' property for thirty days. Each time, the creditor seems to be Jewish, which fits רב הונא but is hard for רב פפא. רב פפא answers that the case may be a כתובה, collected משום חינא. Or it may be a non-Jewish creditor who accepted Jewish law only for the thirty-day announcement, not for waiting until the orphans grow up. רבא then gives a third reason: the father may hold a שובר, a receipt. רב הונא challenges this from a woman who collects from her absent husband, where no one worries about a receipt. רבא answers that the absent-debtor case is different, so people cannot borrow money and run overseas. The amud ends with practical הלכה from רבא, the נהרדעי and רב אשי on when בית דין handles orphans' property and when it appoints an אפוטרופוס.
