A divorce after giving property to הקדש, or with a guarantor for the כתובה: the worry of קינוניא, the debate over why רבי אליעזר and רבי יהושע disagree, and the story of רב הונא.

Overview

The משנה discusses a man who gave all his property to הקדש while he still owes his wife her כתובה. רבי אליעזר says that if he divorces her, he must make a נדר הנאה so he cannot remarry her. רבי יהושע says this is not needed. רבן שמעון בן גמליאל applies the same worry to a ערב (guarantor) for the כתובה. The גמרא first explains that the argument is about whether people plot (קינוניא) against הקדש. It answers רב הונא's ruling about a dying man by limiting the argument to a healthy person. Next it tries explaining the argument through vows made in public or על דעת רבים. It rejects those explanations because of אמימר's ruling and רבי יהושע's wording "אינו צריך." It concludes that the argument is about undoing a הקדש through שאלה, and a ברייתא links this to בית שמאי and בית הלל on הקדש made by mistake. Finally, a story tells of אביי's idea to help the poor רב הונא get money from his father, who had guaranteed the כתובה. The גמרא discusses רבא's objection, whether the advice was proper, and whether a guarantor of a כתובה must pay at all. That last question is answered on the next amud.
