Whether meat slaughtered on שבת or יום הכיפורים may be eaten that day, according to רבי יהודה's rule of הכנה, and whether רבי יהודה accepts ברירה.

Overview

The משנה says that someone who slaughters on שבת or יום הכיפורים has done a serious sin, but the שחיטה itself is kosher. רב adds that the meat may not be eaten that same day, and the scholars said this follows רבי יהודה. רבי אבא explains that this is רבי יהודה's rule of הכנה: something that was not ready before שבת may not be used on שבת, like an animal that died on שבת and only then became food for dogs. אביי objects that the slaughtered animal was always meant for people. רבי אבא answers that a living animal is kept for raising, not eating. אביי then asks how anyone may slaughter on יום טוב according to רבי יהודה. רבי אבא answers that a living animal stands for both purposes, and slaughtering it shows after the fact that it was meant for eating. That answer relies on ברירה, and the גמרא challenges it, because רבי יהודה is known to reject ברירה. It begins checking the source for that claim with a ברייתא about wine bought from כותים, and the discussion continues on the next amud.
