Shrinking an oversized קרפף, partitions on top of partitions (for שבת and for acquiring a גר's property), and whether a roofed area counts toward a קרפף's size

Overview

This amud opens by finishing an earlier מחלוקת about carrying where there are no דיורין (residents). The גמרא then asks how to shrink a קרפף larger than בית סאתים so that carrying becomes permitted. Trees do not count. A column 4 טפחים wide, or a new partition set 4 טפחים back from the wall, does count. For the 3-to-4 טפחים range, רבה says it works because it is beyond לבוד, and רבא says it does not because it is not a מקום ארבעה. רב שימי reports a version where they argue only about plaster that cannot stand on its own. Next comes a partition built at a mound's edge, which is a 'partition on top of a partition.' The גמרא proves that רב חסדא holds it works for שבת, though it does not acquire a גר's property, while רב ששת says it does not work even for שבת. רבה בר בר חנה asks what happens if the lower walls sink. The גמרא argues the answer is already known both for acquiring property (the turnip case) and for שבת (a ברייתא about partitions made on שבת, with רב נחמן's limit applying only to מזיד). A story of רב נחמן ruling against a woman's partition on a partition follows. Finally, רבא and רבי זירא argue whether a roofed section adds to a קרפף's size, and the גמרא suggests linking this to רב and שמואל's dispute over פי תקרה יורד וסותם.

Opening lines

מַאן דְּשָׁרֵי — דְּהָא לֵיכָּא דָּיוֹרִין.

The one who permits — because there are no residents.

וּמַאן דְּאָסַר —

And the one who forbids —

זִימְנִין דְּהָוֵי בַּהּ דָּיוֹרִין

sometimes there are residents in it

וְאָתֵי לְטַלְטוֹלֵי.

and they will come to carry.

The steps (37)

  1. StatementReasons behind the permitting and forbidding opinions
  2. StatementPlanting trees does not reduce an oversized enclosure
  3. StatementA column ten high and four wide reduces; under three does not
  4. StatementDispute about a column between three and four wide
  5. Statementרבה's reason: it is beyond the rule of לבוד
  6. Statementרבא's reason: under four is not significant
  7. StatementA new partition built a distance from the wall
  8. Statementרבה's reason: the partition is outside the rule of לבוד
  9. Statementרבא's reason: a space under 4 טפחים is not significant
  10. Statementרב שימי's lenient version: plastering the wall
  11. Statementרבה's reason: right now, the plaster is standing
  12. Statementרבא's reason: plaster that cannot stand alone is nothing
  13. StatementA partition built four טפחים from the mound works
  14. StatementDispute when the partition is very close to the mound
  15. ProofProving that רב חסדא is the one who says it works
  16. Conclusionרב ששת disagrees, so the 'it works' opinion belongs to רב חסדא
  17. Statementרב חסדא: רב ששת agrees that a partition on top of the mound works
  18. QuestionWhy does רב ששת agree here?
  19. ResponseBecause he lives inside the space of the upper walls
  20. QuestionWhat if the lower partitions sink and only the upper ones remain?
  21. QuestionWhat area of law is the question about?
  22. RejectionIf it is about a convert's property, it is already known
  23. ProofThe turnip seeds case
  24. QuestionWhy doesn't the one who sowed acquire?
  25. ResponseAn improvement that happens by itself does not acquire
  26. ResponseIf it is about שבת, it is a partition made on שבת
  27. ProofA partition made on שבת is still a partition
  28. Challengeרב נחמן limited the rule about partitions made on שבת
  29. Resolutionרב נחמן's limit is only for a partition built on purpose
  30. ProofA real case: plowing beat building a partition
  31. Conclusionרב נחמן explains to the woman why she lost
  32. StatementA yard of three units with one unit roofed: רבא says the roofed part counts
  33. Statementרבי זירא says the roofed part does not count
  34. QuestionIs this the same argument as רב and שמואל?
  35. ProofThe older dispute about a porch in a field
  36. StatementWhy רב allows carrying: the roof edge acts as a wall
  37. StatementWhy שמואל limits carrying: no imaginary wall
