Whether forced giving counts as 'giving' under הלל's תקנה, the rule that the הלכה follows רבן שמעון בן גמליאל, and why a גט given on condition that the paper be returned is valid.

Overview

The amud begins by asking whether giving money to someone against his will counts as 'giving.' This matters for a גט given 'on condition that you give me two hundred זוז.' רבא tries to learn the answer from הלל's תקנה about a house in a walled city, and the גמרא reports two opposite versions of his proof. רב פפא (or רב שימי בר אשי) rejects both, so הלל's תקנה proves nothing either way. Next, רבי יוחנן rules that the הלכה follows רבן שמעון בן גמליאל in the משנה except in three cases: ערב, צידן and ראיה אחרונה. Then a ברייתא says a husband who keeps the paper of the גט for himself has not divorced his wife, but if he makes returning the paper a condition, she is divorced. רב חסדא explains this through רבן שמעון בן גמליאל, and אביי through רבי מאיר's doubled condition. רבא gives his own reason: the action came before the condition. רב אדא בר אהבה then challenges רבא from בני גד ובני ראובן, where the condition and the action were about two separate matters, and his argument continues on the next amud.

  1. Proofרבא's inference: forced giving normally doesn't count
  2. Rejectionרב פפא: maybe Hillel's rule was only for when the buyer was absent
  3. StatementSecond version: רבא infers that forced giving in person does count
  4. Rejectionרב פפא: maybe even in person, forced giving doesn't count
  5. StatementThe הלכה follows רבן שמעון בן גמליאל except in three cases
  6. StatementThe paper is mine compared with return the paper to me
  7. ChallengeWhy do the two halves of the ברייתא differ?
  8. ResolutionThe ברייתא follows רבן שמעון בן גמליאל: she can pay the value
  9. Challengeאביי objects: paying the value may only work when the item is gone
  10. Resolutionאביי's new answer: the ברייתא follows רבי מאיר's doubled-condition rule
  11. Challengeרבא objects: would a doubled condition really block the גט here?
  12. ProofA condition must come before the action, and here it came after
  13. Resolutionרבא's own answer: the action came before the condition
  14. Challengeרב אדא בר אהבה questions רבא's reason
  15. ProofThe model case: condition about one thing, action about another
