Two wives and כתובת בנין דכרין: lessons from the משנה, רב אשי's challenges, and the תנאים who argue about one wife dying in the husband's lifetime and one after his death
Overview
The גמרא first finishes a point about the משנה's wording: the first clause also uses the word 'precedes.' It then draws three lessons from the משנה's case of a man who married a first wife and then a second. First, the first wife's sons get כתובת בנין דכרין even when one wife died in his lifetime and the other after his death. Second, one wife's כתובה can count as the needed surplus for the other. Third, כתובת בנין דכרין cannot be collected from liened property. רב אשי pushes off the first two lessons by reading the משנה differently. The גמרא then shows that the case of one wife dying in his lifetime and one after his death is argued by the תנאים בן ננס and רבי עקיבא. רבה reports that the רבנן of בי רב saw their argument as being about surplus, and he adds that everyone agrees a creditor's payment counts as surplus. רב יוסף objects from רבי עקיבא's own words and goes back to the first explanation. He then links it to an argument between the תנא קמא and רבי שמעון in a ברייתא; the גמרא begins to push that link off, and the thought continues on the next amud.

נָשָׂא אֶת הָרִאשׁוֹנָה.
He married the first woman.

- ResolutionThe first clause uses the same word 'precedes'
- StatementThree lessons from the משנה; first: no worry about quarreling
- ProofProof from the word 'precede'
- StatementSecond lesson: one כתובה counts as surplus for the other
- ProofProof that one wife's כתובה can count as the extra money
- StatementThird lesson: male sons' כתובה is not taken from sold property
- ProofProof: otherwise the first wife's sons would beat the second wife's heirs
- Rejectionרב אשי: maybe 'precede' only refers to regular inheritance
- ChallengeWhy mention 'the heirs of the first wife'?
- ResolutionMatching wording: the משנה just mirrors 'the second and her heirs'
- RejectionPushing off the proof that one כתובה can serve as the surplus for the other
- StatementThe case of one wife dying before and one after the husband is a תנאים dispute: בן ננס's view
- Statementרבי עקיבא: the inheritance already passed away from the first wife's sons
- ProofSuggesting the dispute is about whether כתובת בנין דכרין applies here
- RejectionThe Sages of the school of רב explain the argument differently
- StatementSpelling out each side's view
- Statementרבה: everyone agrees about a creditor
- Challengeרב יוסף: רבי עקיבא's wording does not fit
- Statementרב יוסף returns to the first explanation
- StatementA matching argument in a ברייתא
