Conditional חטאות, a נזיר's set-aside money, and מעילה with blood and נסכים

Overview

The amud opens with the end of a משנה about חטאות. When the owner has not yet gotten his כפרה, the animal grazes until it gets a מום and is sold, and it still makes a תמורה and has מעילה. The גמרא explains why the משנה splits only the last cases: their rule depends on the owner's כפרה. It also explains why the same משנה appears both in מסכת תמורה and here. A new משנה teaches that money a נזיר set aside for his offerings without dividing it up may not be used, but has no מעילה, because every coin could go to the שלמים. It also rules on what happens to his money if he dies. ריש לקיש asks why the משנה did not teach the same rule for bird-offering money, and רבא answers that the Torah never calls for unfit birds. A third משנה, from רבי שמעון, teaches that blood is lenient at first and strict at the end, while נסכים are the opposite. The גמרא brings a dispute about מעילה with blood and gives sources for the view that it has none. It then challenges רבי יוחנן's source, and the discussion continues on the next amud.

Opening lines

וְאִם עַד שֶׁלֹּא כִּיפְּרוּ הַבְּעָלִים –

And if before the owners achieved atonement

תִּרְעֶה עַד שֶׁתִּסְתָּאֵב,

it shall graze until it becomes blemished,

וְתִמָּכֵר וְיִקְחוּ בְּדָמֶיהָ אַחֶרֶת.

and it shall be sold, and they shall buy another with its money.

וְעוֹשֶׂה תְּמוּרָה, וּמוֹעֲלִין בָּהּ.

And it makes a substitute, and one is liable for misusing it.
