Does a נדר against ירק include דלועין? The dispute between the רבנן and רבי עקיבא about a שליח who has to check with his sender, and how that principle applies to a שליח who misuses הקדש.
Overview
The משנה teaches that someone who vows off ירק may still eat דלועין, but רבי עקיבא forbids them. The רבנן try to prove their view from a messenger sent to buy vegetables, and רבי עקיבא turns the same example into proof for his side. The גמרא asks how a vow on 'vegetables' could include gourds. עולא explains that the person said 'a vegetable cooked in a pot.' The גמרא then states the principle behind the dispute: if a שליח has to check with his sender about an item, is it a different kind or the same kind? אביי adds that even רבי עקיבא would not give מלקות for eating gourds. The גמרא then quotes a משנה in מעילה: a שליח who switches meat and liver is himself guilty of מעילה. רב חסדא says this משנה cannot follow רבי עקיבא, and אביי begins to answer that it can, an answer that continues on the next amud.
