Repaying eaten תרומה by measure or by value, and whether תרומה of חמץ on פסח has value that must be repaid

Overview

This amud opens with the end of a ברייתא: even one who anoints with תרומה oil pays a חומש, and if he uses up that חומש he pays a חומש of the חומש. The גמרא then asks whether eaten תרומה is repaid by the amount eaten (לפי מדה) or by its money value (לפי דמים). If the price dropped, he clearly pays the higher original value, like a גזלן. The real question is when the price rose. רב יוסף tries to prove 'by measure' from a ברייתא that praises one who repays dried figs with dates, but אביי explains that the praise is for paying with a fruit that sells easily. Our משנה obligates one who accidentally eats תרומה of חמץ on פסח to pay. The גמרא shows this can fit 'by value' if the משנה follows רבי יוסי הגלילי, who permits benefit from חמץ on פסח, together with רבי נחוניא בן הקנה, who exempts a deliberate כרת act from payment. Finally, two ברייתות record תנאים arguing over whether one who eats תרומת חמץ on פסח must pay. Each debate centers on whether such חמץ has any permitted use, such as burning it for fuel.

The steps (21)

  1. StatementAnointing with תרומה oil also requires a חומש, and even a חומש of the חומש
  2. QuestionDoes one repay תרומה by amount or by money value?
  3. StatementWhen the price went down, he clearly pays the original value, like a thief
  4. QuestionThe real question: when the price went up
  5. Proofרב יוסף cites a ברייתא: paying dates for figs earns a blessing
  6. ProofThe blessing only makes sense if payment is by measure
  7. Rejectionאביי: The blessing is for paying with a more sellable fruit
  8. ChallengeChallenge from the משנה: חמץ on פסח has no value
  9. ResolutionThe משנה follows רבי יוסי הגלילי, so the חמץ has value
  10. ChallengeChallenge from the end of the משנה: Why is the deliberate eater exempt?
  11. ResolutionThe משנה also follows רבי נחוניא בן הקנה
  12. ProofThe question matches a dispute between תנאים
  13. Challengeרבי עקיבא asks what benefit there is
  14. Resolutionרבי יוחנן בן נורי points to impure תרומה
  15. Rejectionרבי עקיבא says impure תרומה can be burned, but חמץ cannot
  16. StatementThe dispute applies only to תרומה that later became חמץ
  17. ProofA second ברייתא learns the same dispute from a verse
  18. Challengeרבי אליעזר בן יעקב asks what benefit there is
  19. Resolutionרבי אלעזר חסמא points to impure תרומה
  20. RejectionImpure תרומה can at least be burned, but חמץ on פסח cannot
  21. ResolutionEven חמץ on פסח can be fed to a dog or used as fuel
