Repaying for eaten תרומה (by value vs. by measure, and the כזית and פרוטה minimums), and a ברייתא on why intentional מעילה brings no קרבן
Overview
אביי explains that רבי עקיבא and רבי יוחנן בן נורי both hold חמץ בפסח is אסור בהנאה. They argue only about how a non-כהן repays for eaten תרומה: by value (worthless חמץ, so nothing owed) or by measure (he returns the same amount). The גמרא proves that רבי יוחנן בן נורי does not follow רבי יוסי הגלילי. A ברייתא then sets the minimum for paying קרן וחומש. The תנא קמא says a כזית, from the word יאכל. אבא שאול says a פרוטה's worth, from the word ונתן. Another ברייתא rules that food worth a פרוטה but smaller than a כזית obligates only the קרן. רב פפא claims this fits אבא שאול, who needs both amounts, but a משנה refutes him with a תיובתא. The גמרא then brings a ברייתא on why intentional מעילה brings no קרבן. רב נחמן בר יצחק says it ranks כרת and מיתה inconsistently. רב חייא בר אבין answers that מעילה is liable even below a כזית, but reports that רבה and רב שׁשת attacked that answer, and their challenge continues on the next amud.

- Statementאביי explains what the dispute is really about
- ChallengeIsn't that obvious?
- ResolutionWhy אביי needed to say it
- ChallengeMaybe the alternate reading is actually right
- ResolutionProof: רבי יוחנן בן נורי did not make the dog argument
- StatementMinimum amount for paying for eaten תרומה
- QuestionWhat is the תנא קמא's reason?
- ResponseThe פסוק says eating, and eating means a כזית
- QuestionWhat is אבא שאול's source?
- ResponseThe word 'and he shall give' requires a פרוטה
- ChallengeBut the verse also says 'eats'
- Resolution'Eats' excludes someone who damages
- ChallengeBut the verse also says 'and he shall give'
- Resolution'And he shall give' requires something fit to be holy
- StatementLess than a כזית: pay the קרן but not the חומש
- ChallengeWhat case could this be?
- ResolutionWorth a פרוטה but less than a כזית
- ProofThe רבנן say this ברייתא is not like אבא שאול
- Rejectionאבא שאול requires both
- ChallengeDoes אבא שאול really require two conditions?
- Conclusionרב פפא is conclusively refuted
- Statementרב פפא also retracted; a ברייתא on intentional מעילה
- ChallengeWhy not derive the exemption by קל וחומר?
- RejectionThe קל וחומר fails because מעילה carries מיתה
- ChallengeThe תנא seems inconsistent about which punishment is more severe
- ResolutionThe stringency of מעילה is about the minimum amount, not the type of punishment
- Conclusionרב נחמן בר יצחק accepts the answer
- Challengeרבה and רב שׁשת already attacked this answer
