The sixteenth case of a woman who exempts her צרה, and the מחלוקת between ריש לקיש and רבי יוחנן over כרת for a חלוצה and her צרה
Overview
The גמרא finishes a special case: a man's mother, raped by his father, later marries his paternal brother. When that brother dies childless, she exempts her צרה from the son, so this is added as a sixteenth case to the משנה's fifteen. ריש לקיש asks why the משנה does not also list a man who did חליצה, then betrothed the same woman and died. רבי יוחנן answers that this case cannot produce a צרת צרה, and the גמרא explains he was answering on ריש לקיש's terms, since in his own view a חלוצה is only a לאו. The גמרא then quotes their full מחלוקת. ריש לקיש says the חולץ has only a לאו with the חלוצה, while the other brothers, and everyone with the צרה, get כרת. He learns this from the פסוק "אשר לא יבנה". רבי יוחנן says no one gets כרת, because one חליצה acts for all the brothers and all the wives. רבי יוחנן challenges ריש לקיש from a ברייתא, ריש לקיש answers from its ending, and רב ששת splits the ברייתא between the רבנן and רבי עקיבא. The amud ends by asking why the ברייתא did not name רבי עקיבא, and that question continues on the next amud.
Opening lines
הָיְתָה אִמּוֹ אֲנוּסַת אָבִיו,
If his mother was a woman raped by his father,
וְנִשֵּׂאת לְאָחִיו מֵאָבִיו,
and she married his brother from his father,
וּמֵת —
and he (that brother) died,
זוֹ הִיא אִמּוֹ שֶׁפּוֹטֶרֶת צָרָתָהּ.
this is the case of his mother who exempts her rival wife.
