Does רבי יוסי accept that one prohibition can take effect on top of another when the new one is an איסור מוסיף (an expanded prohibition)? The case is two brothers married to two sisters, where one brother dies.

Overview

Two brothers married two sisters, and one brother died. If the living brother is with the widow, she is both his אשת אח and his אחות אשה. רבי יוסי usually holds אין איסור חל על איסור, yet he says the man is liable for both. רבי אבהו explains that רבי יוסי agrees an איסור מוסיף, which forbids the woman to new people, does take effect. The גמרא shows this works only if the living brother married first. Forbidding more sisters to the same man is just an איסור כולל, not an איסור מוסיף. So רבא, backed by רבי יוחנן, explains it differently: the man is counted as sinning twice but punished only once, and the double count affects whether he is buried among the completely wicked. The גמרא then brings a related dispute between רבי חייא and בר קפרא in three cases: a זר serving on שבת, a בעל מום serving while טמא, and a זר eating מליקה. רבי חייא says a permission given in the מקדש covers only the proper people, so he is liable twice. בר קפרא says the permission is general, so he is liable once.

Opening lines

אָמַר רַבִּי אֲבָהוּ:

Rabbi Abbahu said:

מוֹדֶה רַבִּי יוֹסֵי בְּאִיסּוּר מוֹסִיף.

Rabbi Yosei agrees in the case of an expanding prohibition.

תִּינַח הֵיכָא דְּנָשָׂא חַי

It works out well where the living brother married first

וְאַחַר כָּךְ נָשָׂא מֵת —

and afterward the brother who later died married
