Sources for the laws of slaughtering, offering up, sprinkling and other עבודות done outside the מקדש
Overview
This amud asks where several laws about doing the עבודה outside the מקדש come from. First, רבא learns the אזהרה against שחיטת חוץ from רבי יונה's comparison of the two words שם in one פסוק. Next, the גמרא asks how we know a person is חייב for offering up outside a קרבן that was already slaughtered outside. רב כהנא, the school of רבי ישמעאל, and רבי יוחנן each give a source. רב ביבי objects that this would make the 36 כריתות in the משנה into 37, and the גמרא admits it is a קשיא. Then a ברייתא brings a מחלוקת between רבי ישמעאל and רבי עקיבא over which פסוק teaches the חיוב for sprinkling blood outside. The גמרא follows how each תנא uses the other's words: או זבח, יביאנו, לעשות אתו, דם יחשב, או אשר ישחט and זה הדבר. Along the way it brings rules about incomplete offerings, slaughtering a bird outside, and pinching a bird outside. Finally, the גמרא explains why one who takes a handful or collects blood outside is פטור: neither שחיטה nor זריקה can serve as a model to make him חייב.
Opening lines
רָבָא אָמַר: כִּדְרַבִּי יוֹנָה,
Rava said: in accordance with Rabbi Yona,
דְּאָמַר רַבִּי יוֹנָה:
as Rabbi Yona said:
אָתְיָא ״שָׁם״–״שָׁם״;
It is learned from "there" and "there";
מָה לְהַלָּן לֹא עָנַשׁ
just as over there, it did not punish
The steps (31)
- Responseרבא learns the warning against slaughtering outside from Rabbi Yona's teaching
- QuestionWhat about offering up outside an animal that was already slaughtered outside?
- Responseרב כהנא reads 'to them' as 'about the nearby section'
- Challengeרבא objects: the word means 'to them,' not 'about them'
- ResponseThe school of רבי ישמעאל: the extra 'and' joins the two sections
- Responseרבי יוחנן learns it from the repeated word 'bringing'
- ChallengeThe count of 36 כריתות becomes 37
- QuestionWhere do we learn the rule for sprinkling part of the blood outside?
- Responseרבי ישמעאל learns it from 'דם יחשב,' and רבי עקיבא from 'או זבח'
- QuestionWhat does רבי ישמעאל learn from 'או זבח'?
- Response'Or' teaches that each case counts on its own
- QuestionWhere does רבי עקיבא learn to count each case separately?
- Responseרבי עקיבא learns it from 'he will not bring it'
- Responseרבי ישמעאל needs 'it' to teach that only a complete offering counts
- Responseרבי עקיבא learns the 'complete offering' rule from 'to sacrifice it'
- Responseרבי ישמעאל uses both words for two kinds of incomplete offerings
- ProofA ברייתא supports רבי ישמעאל
- Conclusionרבי עקיבא holds one is liable for incomplete parts fit for burning inside
- QuestionWhat does רבי עקיבא do with 'blood shall be imputed'?
- ResponseIt includes slaughtering a bird outside
- Responseרבי ישמעאל learns bird slaughter from 'or that slaughters'
- Responseרבי עקיבא needs 'or that slaughters' to exclude pinching
- Responseרבי ישמעאל learns the pinching exemption from 'this is the matter'
- ProofA ברייתא: 'or that slaughters' includes a bird
- ChallengeLogic suggests pinching outside should also make one liable
- Conclusion'This is the matter' excludes pinching
- Responseרבי עקיבא needs 'this is the matter' for a different teaching
- QuestionSource for exemption when taking a handful or collecting blood outside
- ChallengeWhy would we ever think he is liable?
- RejectionCannot learn liability from slaughtering
- RejectionCannot learn liability from sprinkling
